‘HATE SPEECH’ CRACKDOWN
The Queensland Parliament has passed new laws criminalising certain forms of ‘hate speech’, marking one of the most significant changes to the state’s legal framework on public expression in recent years.
The legislation, which came into effect earlier this month, specifically targets ‘antisemitic slogans and symbols’, as well as expressions that “threaten or intimidate people on the basis of religion or ethnicity”.

Under the new laws, the use, display or publication of certain phrases and symbols can carry a maximum penalty of up to two years imprisonment.
The legislation has been framed as a ‘necessary step’ to ‘protect communities and religious groups from targeted harassment’, particularly at places of worship.
Two slogans – “From the River to the Sea” and “Globalise the Intifada” – are explicitly prohibited under the new legislation. Government officials argue these phrases are often used in contexts that are ‘antisemitic’ and can ‘incite hostility towards Jewish communities’.
On the first day of enforcement, two protesters were charged for using one of the banned slogans at a demonstration outside the Queensland Parliament.

Queensland Police Commissioner Brett Pointing has said that the law will require “careful judgement from officers” in determining what constitutes a breach.
“This is a challenging area for law enforcement,” a police spokesperson said.
“We must balance protecting the community from hate-driven expression with maintaining the right to peaceful protest and public debate.”
The legislation builds on earlier reforms in Queensland targeting ‘hate-motivated offences’.
Previous measures had already prohibited the public display of Nazi symbols and increased penalties for crimes motivated by prejudice against groups defined by race, religion, sexuality or gender identity.
The new laws extend these protections by criminalising specific verbal and written expressions, particularly in public or at demonstrations.
Supporters of the legislation have emphasised the need to respond to rising incidents of ‘antisemitism’ and ‘extremist activity’.
Queensland Premier David Crisafulli highlighted that the law is intended to ‘safeguard communities’ and ‘prevent targeted harassment at religious institutions’.
“We are sending a clear message that hate speech and intimidation will not be tolerated in our state,” the Premier said.
However, the laws have sparked controversy and raised concerns among civil liberties groups and legal experts. Critics argue that the legislation risks infringing on freedom of expression and may suppress legitimate political debate, particularly surrounding sensitive international issues such as the Israel-Palestine conflict.
Amnesty International Australia described the law as a “serious threat to fundamental freedoms,” warning that its broad definitions could lead to arbitrary enforcement.

Legal analysts have noted the enforcement of these laws will likely test the limits of free speech protections under Australian law. They caution that while the legislation targets specific ‘harmful expressions’, interpretation in real-world situations may prove complex, particularly when slogans or symbols are used in political or academic contexts.
The Queensland government has emphasised that the legislation is narrowly focused and does not intend to criminalise political discussion or criticism of government policies.
Nonetheless, the precise boundaries speech remains a subject of debate.
As Queensland navigates the early days of the law’s enforcement, attention is likely to focus on its practical application and the responses from the public and civil society.
With two arrests already recorded, the legislation has moved quickly from debate to action, signalling the government’s determination to curb what it sees as ‘dangerous hate speech’.
The new hate speech laws are part of a broader national conversation in Australia about the balance between free expression, community safety, and concern over ‘extremist rhetoric.’

Under the legislation, individuals and groups found guilty of “intentionally promoting or inciting hatred against people based on protected characteristics” – including race, religion, ethnicity and other attributes – can face substantial penalties, including prison.
