The Fluoride Action Network (FAN) have provided an update on their important case against the Environmental Protection Agency (EPA), after a pre-trial hearing was conducted last week.
The first update to come from the pre-hearing is that the exchange will take place in-person in San Francisco, with the trial to also be live-streamed on Zoom. All counsel and witnesses will appear live in the court room in San Francisco, as opposed to presenting evidence virtually.
Next up, FAN attorneys say they have introduced evidence that a key EPA witness lied under oath.
The ‘expert’, Dr. Jesus Ibarluzea, says he conducted a study that found not only does fluoride NOT lower IQ, but it can transform an average IQ boy living in non-fluoridated areas to a genius (apparently increasing the IQ of boys by 28 points, if you can believe that).

The study, conducted by Dr. Ibarluzea, features prominently in this case.
At Tuesday’s hearing, FAN’s attorneys presented a document recently obtained under the Freedom of Information Act (FOIA) which they say directly contradicts what Dr. Ibarluzea stated under oath.
During his deposition, Dr. Ibarluzea was reportedly asked whether he ever asked anyone to delete information about his fluoride study, to which he responded “never, never, never, ever.”
According to the FOIA document, however, Dr. Ibarluzea is said to have sent the CDC’s Division of Oral Health an email about his study, which ended with the words: “Please delete this message.”
The contents of the message remain unknown because CDC’s FOIA office redacted the entire email with the exception of the ‘delete this message’ instruction. This is the star ‘expert’ EPA brought forward.
Over the Department of Justice’s (DOJ) objection, the court (to their credit) permitted FAN to introduce this FOIA document as evidence at trial.
After being deposed by FAN attorneys, Dr. Ibarluzea withdrew from any further participation in the case and will not testify in-person at the trial. They do not mess around at FAN, that’s for sure.
Once again, we have more legal evidence of major ‘health’ institutions engaging in major deceptions.
Lastly, we turn our attention to the NTP Report on Fluoride Neurotoxicity, the bombshell suppressed IQ study that was brought to the light last year by FAN during proceedings.
In October and December 2022, FAN introduced evidence in the case showing political pressures had prevented the National Institutes of Health’s National Toxicology Program from releasing its report.
The court lifted the pause on the trial and permitted additional discovery into the NTP review. After extensive negotiations, the DOJ agreed to produce a draft copy of NTP’s suppressed report on fluoride.
At the pre-trial hearing on Tuesday, the court said It no longer mattered that the report was still in draft form. The draft was going to be given “a fair amount of weight” in the trial.
On the question of whether political suppression of the NTP report would factor into the trial, the court reiterated that it is most interested in the scientific merits of the report.
The court also ruled that the NTP’s former Scientific Director will be allowed to testify that the monograph on fluoride was a complete report that NTP’s staff, including himself, believed should be published.
More huge moments in perhaps the most important moves against fluoridation ever undertaken.
After almost eight years, FAN finally have the ‘experts’ exactly where they want them.
EPA TRIAL
The FAN’s fight against the EPA is unprecedented, and has taken the organisation almost an entire decade to get to this point, repeatedly being blocked, dismissed and prevented at every turn.
This is a campaign that could be remembered forever in the history books in a similar vein to breakthrough evidence of the past against smoking, asbestos, and more.
Below is a recap on FAN’s extensive campaign to reveal the truth about water fluoridation since 2016.

The Fluoride Action Network has been around forever, certainly since before I started TOTT News, and have been a primary source of information on fluoridation dangers for years.
In 2016, however, the network began this historic fight, taking it directly to the agencies themselves.
November 2016
Watchdog organisations serve the EPA with a petition calling on the agency to ban the addition of fluoridation chemicals to public water supplies due to the risks these chemicals pose to the brain.
February 2017
In classic fashion, EPA denies the petition just months later.
April 2017
In response, FAN and other organisations sue the EPA in early-2017.
November 2017
In November 2017, we saw the first court hearing on EPA’s Motion to Dismiss being sued.
December 2017
A month later, the court rules in plaintiffs’ favour, denying EPA’s motion to dismiss.
The Court noted: “The purpose of citizen petitions is to ensure the EPA does not overlook unreasonable risks to health or the environment.”
In response, just days later, EPA asks for a protective order limiting review to the administrative record.
February 2018
Next up, the court rules in plaintiffs’ favour, denying the EPAs motion to limit review to the administrative record, thus allowing use of important new scientific studies published since the case was initiated.
October 2018
The court, once again to their credit, orders more discovery in the case.
October 2019
Plaintiffs and defendants submit motions for summary judgement one year later, right before the ‘coronavirus’ outbreak that threw everything off in the world.
December 2019
In December 2019, the plaintiffs’ file proposed findings of fact and trial brief, and the court releases an order denying plaintiffs’ and defendant’s motions for summary judgment.
This means that the FAN case would go forward, according to the courts, with the initial trial scheduled for 20 April, 2020, set to run for two weeks.
April 2020
The trial was then postponed on 17 March 2020 due to the ‘coronavirus’ ‘outbreak’
May 2020
A virtual pre-trial hearing was held, where the court allowed plaintiff’s expert witnesses to participate in trial, rejecting a challenge by EPA. The court said at the time that the benefits of fluoridation were not to be part of trial, denying effort by EPA to include benefits.
May 2020
Trial declarations from plaintiffs’ witnesses were submitted.
June 2020
A two week trial via Zoom (June 8th-19th) was undertaken.
August 2020
The ending of the trial was sudden and unexpected just two months later, as the judge asked the two parties to work out an agreement, suggesting various scenarios.
November 2020
To this end, the FAN filed for a supplement and referred to the original 2016 petition filed by plaintiffs, asking EPA to reconsider their denial of 2016 Petition and respond to the issue.
Beginning 2021
Months passed by, and the judge had still not issued a ruling on the standoff.
After the trial ended, the judge held several status hearings with the attorneys and informed them that he wanted two documents before making a ruling.
1. National Toxicology Program’s Systematic Review of Fluoride’s Neurotoxicity. The NTP spent over 5 years and at least a million dollars to produce this document, which was delayed by top HHS officials and finally released under court order in September 2022.
2. A Benchmark Dose Analysis of Fluoride’s Neurotoxicity. This document was published in June 2021.
This caused even more delays, as bureaucrats began to hold up proceedings.
June 2021
In mid-2021, the plaintiffs filed a motion to lift pause on the trial.
January 2022
Seven months later, a status hearing was held. The judge reiterates his desire to wait until the NTP publishes the final version of their review on fluoride’s neurotoxicity before continuing with the trial.
October 2022
Ten months later, the court ruled in favour of plaintiff’s motion to lift the stay.
This signalled the court’s desire to move forward with the case, and was a major breakthrough (finally). The court subsequently re-opens attempts to examine an updated version of the NTP review.
January 2023
12 months ago, another status hearing was held.
Here, the court ruled against the EPA’s request for additional delay of the trial, acknowledging that “…justice delayed is justice denied”. The court set a timeline for the final phase leading up to a verdict.
April 2023
In April 2023, another status hearing was held where dates were set for the second phase of the trial.
Soon after, the NTP review was released, as TOTT News reported on.
This was where we last left with updates on the trial prior to this piece.
October 2023
In October, yet another status hearing was held that would set the course for the latest round of updates.
The expiration of the CARES Act means that our attorneys will present live from the federal courthouse in San Francisco, as opposed to a Zoom trial, it was ruled.
January 16, 2024
Last week, the pre-trial hearing was held, with updates provided in this piece above.
Up next..
Now, after years and years of waiting and battling, the EPA will finally get their day incourt.
Trial dates are currently scheduled for 31 January 2024 through 13 February 2024, in which all rulings and decisions, as well as the evidence already presented, will be put to the test in the courts.

Let’s hope another ‘once in a generation pandemic’ doesn’t throw things off again in the next few weeks.

When FAN finally wins their case, and fluoride is judged to be harmful (by no means certain as most courts belong to “the system”), how long will it take before Australian “health” authorities take any notice?
No surprise that a fluoride “expert” is found to be lying. This will always be the case with anyone defending government mandating of this neurotoxin (which provides no benefits to humans, only harm) for water supplies. It takes a rarefied type of psychopath to devise this means of dumping a toxic waste product of fertiliser and mining, and use it to dumb down the populace (so it is easier to control) and then pretend that it reduces tooth decay…and most people have swallowed it.
Most likely in Australia they will just ignore it, just like everything else, business as ususal.
